SMS Terms of Service

Use of the Forbes Road Career & Technology Center
(“FRCTC”) text message-based services (the “Service”), facilitated through a
third-party service provider, is subject to the following Terms of Service (the
“Agreement”). This Agreement constitutes a legally binding contract between you
and FRCTC. Please read it carefully. By opting in to the Service, you agree to
these terms.

1.     
Opting In to the Service

FRCTC provides multiple ways to opt in to the Service,
including:

• Entering
  your phone number on our website
• Sending
  a Mobile Originating (MO) message with an advertised keyword
• Completing
  a paper form that includes your phone number
• Signing
  up at a point-of-sale or in-person location

Your opt-in signifies your prior express written consent to
receive SMS messages from FRCTC, as required by the Telephone Consumer
Protection Act (TCPA).

2.     
Opting Out of the Service

You may cancel the Service at any time by texting “STOP” to
the originating phone number. After receiving your “STOP” message, we will send
a confirmation SMS to verify your unsubscription. You will no longer receive
SMS messages from us unless you opt in again. To rejoin, sign up as you did
initially, and we will resume sending SMS messages to you.

3.     
Message and Data Rates

Message and data rates may apply for messages sent to you
from FRCTC and to FRCTC from you, depending on your wireless plan. FRCTC is not
liable for any costs associated with these messages. You will receive recurring
messages as part of the Service. For questions about your text or data plan,
contact your wireless provider.

4.     
Message Visibility

You acknowledge that anyone with access to your mobile phone
may view messages sent through the Service. FRCTC is not liable for any
consequences arising from such access.

5.     
Consent Not Required for Other Services

Consent to receive SMS messages through the Service is not a
condition of receiving any other services from FRCTC.

6.     
Authorization for Automated Messaging

By opting in to the Service and providing your mobile phone
number, you authorize FRCTC, through our third-party service provider, to
contact you via SMS at that number using an automatic telephone dialing system,
prerecorded messages, or other computer-assisted technology, as permitted by
applicable law. This authorization applies to promotional, informational, and
administrative messages related to the Service.

7.     
Compliance with FCC Regulations

FRCTC complies with FCC regulations, including the TCPA. We
will not send marketing or promotional SMS messages without your prior express
written consent, which you may revoke at any time by opting out. Our
third-party service provider is contractually obligated to comply with
applicable regulations when delivering messages on our behalf.

8.     
Changes to the Terms

FRCTC reserves the right to modify this Agreement at any
time without prior notice. The date of the last update is posted at the top of
this Agreement. Changes are effective upon posting at https://forbesroad.org/sms-terms-of-service/. Your continued use of the Service after changes are posted
constitutes your acceptance of the updated terms.
